The Code on wages, which replaces the Payment of Bonus Act, 1965, bars bonuses for those facing sexual harassment charges against them. Previously this provision was only applicable to employees dismissed for fraud, violent conduct and theft or sabotage. Now, the provision does not limit the sexual harassment to the physical office space and considers the IC’s decision equivalent to a conviction or acquittal which will form the basis to withhold the bonus
